Termination of Paternal Rights

My son is almost 3 and I have been married for a year to the person he has always called DAD. My husband has been in my sons life since he was born.
My son's biological father has NEVER seen nor has he made any attempts to see my child. He lives in another state and has never even asked to see him. We have always been in agreement that termination of rights would be filed and my husband would then adopt my son and give him our last name.
My concern is that now I am worried that his biological father might not want to terminate his rights!! I sought paternity and because I could not afford to pay for it I went throught the State of Texas therefore child support was also enforced. I do not get, nor do I want or ask for, any other financial aid from his biological father. He only pays $400/month and we are also in agreement that all back child support will not have to be paid as soon as term of rights is finalized.
I don't know what to do, I have my family and he has his, I feel like he is only threatening me with seeing my son and persuing visitation because he wants to "lite a fire under my rear" if you know what I mean!! What do I do! He has never wanted to see my son or even cared. My son is 2 1/2 and this would be devistating to him at such a young age. He has threatened to bring police officers to my family's home and take my son for the weekend. I can't find anywhere in my paper work from the attorney general's office where it states that we established ANY visitation at all!
PLEASE I AM DESPERATE FOR ANY HELP

i understand how you feel my son is almost 2 and i had to file child support to keep him on his insurance for ky. i am married and my husband is the only father he's ever known and i want to keep it that way. now the papers from child support division say that my son must spend 6 consecutive nights with a man he knows nothing about inorder for him to get child support. i don't think this is fair and i need to know if there is any way around this problem.

I understand what you are going through.  My son is 8 and his bioligical father has never seen him.  My husband has been with me since his birth, and is now wanting to adopt him.  We just found his father this year, and are trying to get the adoption finalized.  Now his father is wanting to be a part of his life.  He was ordered to pay child support when my son was 2, and I have never received a payment.  He owes my son $20,000 in back support.  I just entered in a temporary custody order stating that his biological father cannot see him.  I have full custody.  Hang in there....get a lawyer as soon as possible.
