I have fullcustody of my two sons,for the last 4 yrs , ages 7 &9 . When my youngest was six months old , I divorced my wife for the first time because of her adultress behavior. In this divorce she had joint custody, for about one week. I took temperary fullcustody of the boys , after she abandon them at a daycare. She went missing for over a week on a drunken ,druged out beng. She never called ,even to see if anyone had found the boys.Time passed and she weezled her way back into our lives. Her father and I sent her to a psychitrist, who's diagnosis was , other than mental problems (she claimed postpardom depression), she needed drug and alchol rehabilitation. She absolutely refused any such treatment. About a year has passed and she seemed to be doing alot better. So, from pressure from her parents and her and the desire to hold my family together , I remarried her ( big mistake). It wasn't long, before the trouble started again. The drinking and drugs, the staying out, until early morning hours and everything else that goes along with this type of life style. The hole time ,I'm working a full time job and trying to give my boy's a proper up bringing. This went on ,for what seemed to be a long time, my youngest was soon to be 3 .During this time, I developed a strange sever ILLNESS, that would come and go, as she came and went. Doctors were unable to diagnose this and I saw many specialist.I thought moving away from the apartment building would help, this is where alot of the parting was going on. Keep in mind I'm the outsider, this is her small town. So, we moved into a small farm house, right outside of town. We werent there 1 month and she left to become a married mans biker chic, working in bars and strip clubs.So, I divorced her again and she willingly signed over full custody of the boys. By this time my youngest is three years old. She showed up for his 3rd birthday party, after that it would be over a year before we would see or hear from her again.I bought a house and moved to the next town over. I enrolled the boys into a Christian daycare, (Did I mention during this entire ordeal ,I managed to keep them in Church , Sunday school and Boyscouts). I would work fulltime as a maintenance Tech. and would drop the boys off, on my way to work and pick them up after, the Christiancare would take them to school and pick them up. I heard very little from her or her family for the next couple of years. The mystery illness that I suffered from slowly disapated,( althow I can still feel some lingerig effects from time to time) and life was looking up.I met my new wife Tanya, who is also a single parent, from a tragic accident ,when she was seven months pregnant with her son Layton, her husband was killed in a car accident. Not long after I met Tanya , I was laidoff from my job, of nearly ten years.This is when all the trouble started with the Exwife. When I tryed to move to Nashville, where there is ample oppurtunity to make the same money or even more money , than I earned here ,around 40k. To make a long story short , the exwife tried to take custody of the children by using her first set of divorce papers, that stated she had joint custody , to obtain a lawyer. To prevent this , I was ordered by the court to move back into my house in the small town and put them back into the school system in which they had been attending.At this time, the judge reinstated my full custody and ordered that she pay child support in the amount of $50.00 per week for both children. Although, she does not pay her child support , little is done to enforce it. If this were me, not paying my child support the story would be very different I'm sure. I found a job making 10k less, this really hurt but all the industry has left or leaving this area and jobs are hard to come by. Now, another year has passed and I've been laidoff again and we are being plagued by harrasment from the Exwife. From phone calls ,to calling to police about an Xbox being unplugged,( Little things but enough to cause stress) we really have to walk on eggshells these days. When I told the Exwife I was planning to move to Nashville ,(where I have a maintenance managers job, making 40k plus benefits and my wife still owns a very nice 4,000 square foot home, where each child could have there own room and plenty of room for us all) .Thats when the trouble starts again. I tryed to expain to her that I have looked for employment here until my unemployment has run out, there are no jobs here anymore.When the exwife, got the notice from My attorney of my intentions, she asked if she could take the children to Atlanta to visit her mother, who was living there with her boyfriend. I refused to let her take the boys, mainly because of her actions the in the previous weeks, such as leaving her new husband and moving in with her grandmother,she had been to the boys school , upsetting the oldest and requesting reportcards, she had never done this before. The only thing I could figure, based on her actions was she entended to take them out of state and file for custody. So , as I stated ,I refused to give my permission and she had a criminal warrant taken out for my arrest. She went to the Sheriffs dept. with her first divorce papers, (the ones when she had joint custody) and caimed she had joint custody and that I was interfering with her custodial rights. So, the sheriffs dept. issued a criminal warrant for my arrest, luckily when the deputy showed up , I had divorce papers in hand and instead of arresting me, he let me turn myself in at the local Sheriffs Dept.I had to hire an Attorney for this and we went to court, it was dimissed and again nothing was done to her, for using the obsolete divorce papers. That she has used many times before, even to obtain TENNCARE health insurance for the Children. Because, she was ordered by the court to provide Health Insurance for the Children. Finally ,I obtained another attorney, we are petitioning the court for a hearing on Friday july21 2006 for permission to move to Nashville and of course, the Exwife is raising hell. She has obtained a lawyer and filled a motion that the kids, be put into her custody. Now, you wouldn't think any saine judge would even consider such an idea and I think that the judge I'm dealing with, is a reasonable and wise man. I just wish I had the Attorney, I used before, enstead I have a local Attorney, that I am Unfamiliar with. I could not use the Nashville attorney , that was used in the previous battle with her, due to my current wife lending him money. While she was his client, he asked her to barrow the seattlement money she was awarded from her husbands death, that he represented her in. Now, this attorney has filed bankruptcy and we are no longer allowed contact with him. Although his morals, ethics and management skills are very questionable, he proved to be an outstanding attorney. My question is what to do in the small town courts , when they seem to do nothing about one of there own committing fraud ,time and time again. Where does it end?
