dui statues for different states

I'm in desperate need for some information. I need to know if the statues for DUI in Texas and Virginia are the same. If someone was convicted in Texas years ago, can that be used against them in Virginia............Please help

Hi Shadow40,

Please note: This is NOT A LEGAL OPINION (just so I don't give you the wrong impression or get in trouble).

My guess is it would depend more on if Virginia "talks" to Texas or checks a database where the Texas conviction would appear on the record. You might look to see if the Virginia DMV website indicates anything at all about how the driving record from other states effects an application for a new license in Virginia (or renewal) for some idea.

In 2006 it is hard to imagine that all states are not talkiing to each other, but other than Nevada, Texas and Virginia would be two at the top of the list who might not share that kind of data.

From the sounds of it, however, it is not the DMV you need to worry about as much as the District Attorney pressing charges of DUI, right? Perhaps you can speak to a public defender or a legal clinic with local knowledge - that's what I'd do in this situation.
