Judge Leonie Brinkema has ruled the US can continue their badly run death penalty phase against Zacarias Moussaoui, accused/confessed 911 al-Qaida conspirator, despite their most recent and stupendous mistakes.

She is barring aviation security testimony as a remedy for the contaminated witnesses who it turns out were more poisoned then thought yesterday.

The court released some of the e-mails involved:

Federal Prosecutors going after Zacarias Moussaou are now seeking a reversal of the ruling by Judge Leonie Brinkema to prevent FAA witnesses from testifying during the death penalty phase.

In a motion they filed today, they said, "but we want them to testify!!!!."

Kidding.

Their motion claimed that the testimony "goes to the very core of our theory of the case."
