I buy a mobile home in calgary,ab. I working with this company ( I'm renovation and framer) in oct- 14-2008, I sing the contract for fix this unit ( contract say star 14-oct-2008 finish 24 0ct-2008) in octuber 20 2008 my manager callme and he say stop the job. because we don't have buyers. oct 24-2004 I talk with the vice-president, and I explain I have the contract, but he say its ok. when i talk to this people I asking wich paper I need because i want to buy this home. he told me fisrt 1750 dls and fill aplication for financing the mobile home, Oct- 25 -2008, I pay this money by ( money order ). nov. ? ?? 2008, I fill the application. nov-27 2008, receive a call .. there U application is approved, can you come for sing the agreement.. nov 27- 2008 sing. agreement to sell and lot rent agreement. down payment 5000 dls I explain I don't have the money now and I asking i can pay this down in 2 parts first 2dec 2008 and second payment 22 dec 2008. this people say yes. but I give U the keys in dec 2 2008. first payment ( by money order ) dec 2 2008 $2500dls. second payment (by money order) because i dont have bank account. $ 3650 I pay this money because I know te ressesion is here. 3 payment january 2 2009. $1200 dls ( by money order ). The agreement incluide a 5000dls dwn pay and this company financing $ 7500dls the total purchase price $12500dls the first month lot rental of 875 and security deposit if $875.00 were due December 1 2008. On octuber 25 2008 I paid the $ 1759 dls first month lot fee and security deposit in good faith NOv 27 2008 i signed the agreement to sell incuiding mortage payment of $151.61 monthly and their tenancy agreement incluiding$875 monthly lot rental fee . at the point the balance due was $6901.01 of wichi had pay 7925.00 with my payment in january 2009 $ 1200 dls meaning I had a credit of 1196.78. after contracting this company several times, they informed me that they no longer has work for me therefore I no longer had an income. on febraury 1 2009 another 875 plus 151.61 was due and taken from my existing credit leaing me acredit of 170.17. on febrary 12 2009 i left the unit and when returned there was a notice terminating my tenancy on feb 20 2009 attached to my door and the door locks had been changed. this company owes me money for the contracted work on the unit in the amount of $4000 dls and also for decks thah I paint in their park in the amount $1080dls On march 1 2009 Iwas in arrears, for the first time, in the amount 856.44. on march 5 2009 a notice abandonment was posted on my door, i was not sure what this meant and ignored i thinking posted in error. on march 18 2008 i eas sererd documennts to attend court. The master in chambers told to this people's to give me the keys to the changed locks, i tried to get the keys however this company made excuses and did not realese the keys until I request them in writing by emailon april 3 2009. i believe this company made agreement to sell the mobile home to me knowing that they would end my contractual work and cause me financial hardship in porder re-possess to mobile home. I know english is not my first language and knowing that company regulary sell mobile homes,Itrusted this company to create correct andaccurate documents and I signed them believing them to be as such. there are many errors in the documents that they have submitted to the court,wich make it ery difficult for me to understand exactly what I signed. the following are errors that i have found: the agreement to sell that company submitted to thecourt was not the agreement to sell that I receied. my copy of the agreement states the purchase price in paragraph 1 as """ forty one thouseand and forur hundred dolar ( 12500 ). dollars. whereas teh copy to the court was corrected to read " twelve thousand and fie dollar (12500). in paragraph 3 in the affidavit of ( other name ) that lease agreement began on noember 1 2008. the amortization schedule was made and date tuesday noember 25 2008. te agreement to seel shcedule A and B both show as printed by this company on 11-25-2008 the mobile home site tenancy agreement was "made effective the 27 nov 2008" paragraph 8 reads nov.1 2008. I did not sign the agreements until noember 27 2008 therefore it's unreasonable to request payment when Ihae no yet signed an agreement to purchase the mobile hoem or to lease the lot the first lot fee and mortage payment were both due in december 1 2008. this comapany Exhibit "b" belong to ( other person other unit ) The tenant ledger starts january 1 2009 and show NSF fees as well as a PAP of1038.61 wich in no way reflects payments that I made to this company,I don't have a bank account wich is why I always paid by money orders. the agreement to sell at paragraph 2 states november 1 2002 as the closing date. the agreement to seel has neer SIGNED by the vendor. the notice of abandonment refers to section 24 of the residential tenancies act ( RSA 1980,chapter r-15.3,wich is no longer in existence and has sice been replace several times. the current act is residential tenancies act, S.A 2004 c. R-17-1 and section 24 of the current act refers to lock and security Device. I beliee the correct act in this matter would be the Mobile Home Site Tenancies Act, and the notice of abandonment is signed at red deer by ( residential manager calgary). office in calgary. I was in the court and they lawyer say to the master. need a time for 1 week more, the lawyer asked them to us in his office to fix things, we all know that if you want to fix the outside because they know you are lost.
we need a recomendation for this problem I'm from mexico, I dont have job,I'm legal in this country. and I know this people want take my home in the beginner. maybe I can put a demmand for : misrepresentation to the authority (a judge in court) false evidence (other contracts) please help me I have my family ( 2 kids ) and we want to know what can i do. thanks. for the time and have a good day.
