Stalking/Sexual assult???

I hope someone can help me with this to!

I was arrested again on the same charge as the first because they saw footprints in the snow going torward my neighbors apt. and I was inside my apt. the hole time! They arrested me (in my opinion it was because I was the only one there with the same charge I guess)because the women down stairs said they saw someone else outside there window, and I thought to my self what the f**K you know! Im in my apt. the whole time this was going on, and the police took me in anyway and I spent 2 nights in jail. Is it leagal for them to add this charge to Voyeurism?
