Rape Case

Dear all,
I am trying to get some help. I live in Guatemala but my uncle he is an illegal immigrant living in NY, about a month and a half a minor girl acused him of rape. since that my uncle have been in jail and they are delaying the hearing, I donīt know why. My unclesīs whife hired a lawyer but it seems to me that he is not doing a good job.
I donīt understhand. Itīs supposed that everyone is innocent untill otherwise is proved. my relatives in NY tells me that the judge sayes that the case has no fundament. but he is still in jail for almost two months and no chance to prove he is innocent, neither the D.A. have been able to prove that he is gulty.
is it normal a process like that?
I signed up to this site because I donīt know where to look for answers. If any one can help me, I will appreciate.
I belive my uncle is innocent and I trust the U.S. legal system, but so far my hopes are going away.
